Tangerine Investment Management Ltd

Litigation funding is a relatively new, but simple idea for investment. Since governments have withdrawn or reduced their support for public funding and in some jurisdictions have changed the law to allow third parties to provide finance to support legal action, several funds have come to market to raise money from investors to step into this gap. Their success is helped by the severe shortage of finance available to law firms from traditional lending sources.
The award winning Tangerine Investment Management Ltd manages 3 Cayman Island domiciled funds that provide finance to law firms or their clients for specific cases. Two of these funds lend money at a fixed cost that has to be repaid, win or lose, and the third fund invests in the case and shares the risk and the rewards.
Axiom Legal Financing Fund & Tangerine Legal Financing Fund are open ended funds that make short term loans to law firms for specific case types. The loans have two layers of insurance protection. Firstly the cases themselves are insured against the possibility of losing and secondly against the law firm defaulting on their repayment obligations to the Fund ensuring therefore that the Loan Capital is insured . The Axiom Fund launched in September 2009 and only lends to English law firms. It has returned 11% - 12% a year to the investor very consistently. Most of the loans it has provided are for professional negligence cases but it also finances divorce cases for high net worth couples. The Fund only supports cases which have a life expectancy of less than 12 months. The Tangerine Legal Financing Fund follows the same lending model and has recently been launched to make loans world-wide. As loans are expected to turn round in a year, these funds have very good liquidity. Axiom is denominated in Sterling but has feeder funds in most major currencies that are hedged to provide similar returns. Tangerine is USD denominated and also offers hedged share classes in most main currencies.
Tangerine Litigation Fund is a closed end fund that invests in the cases by providing finance at the risk of the fund and then taking a share of the final awards. Where possible, insurance is taken to recover costs if a case loses. A portfolio of cases is constructed to minimise the risk of any particular case. As the capital is drawn down by the law firms over the duration of the case, the fund can also make short term loans in the early life of the fund to maximise profits. The fund is targeting to return 200-300% over the expected 3-4 year life of the fund. Investors may then redeem their investment or chose to roll it over into another series/share class.
